One post-election scenario I've seen is that one or more Supreme Court justices will retire
The thinking is it will be easier to get a new justice approved by the existing Senate, and much harder after January 3rd.
I don't think Alito or Thomas will retire in the middle of the Supreme Court term, but Thomas will retire in June at the end of the current term.

One or more will retire right after the midterm and then the Bagger senate will rush through the confirmation of Ted Cruz and that Cannon qunt in Florida. Because of course Baggers don't follow any of their own rules.
