When I was in Florida last year, I was really surprised that the restaurants had almost all gone to service charges, and then
a lower than usual tip. For example, the restaurant would charge 18% service, then would have a 2%, 5%, 8% suggested tip.

Here is the problem. Tips can only go to servers, and direct customer support staff, so bussers and bartenders get
tipped out. But the restaurants would like to use tips to pay kitchen staff as well, and even managers (who are often servers
doing management that shift). They can't do that.

So, a method like this one gives them an alternative. They are going to collect a service charge for the kitchen staff and others
essentially giving them a percentage of sales. They'll then give the servers the same deal, a percentage of sales, plus any
tips that are left.

The 1 cent per hour is to keep them as W-2 employees. Changes are high Florida law does not allow servers to be 1099s.
I know in the Illinois case, laws limit what jobs can be 1099s.

The minimum wage applies in the sense that at the end of the pay period, wages paid (.01/hour + sales commission) must be
at least (min wage * hours worked).

Now here is what I think of all this.

One missing piece of this puzzle is how the service charge is divided. What is the pay for the kitchen staff? Are they getting
min wage + service charge? Is the owner reducing / eliminating the wage when the service charge compensates?

Or let me put it in a practical way. How does the pay for kitchen staff vary with sales? Is the restaurant, by effect, reducing
its server pay and increasing pay for the kitchen staff?

Several of the servers in Sausalito, who lived a nice cash only life for years, have mentioned to me that they
aren't getting any social security because they never declared the tip income.

This is something that the "no tax on tips" law could help with, if structured properly (don't know if it is), it could
allow for tips to be declared and counted for SS but not for income tax. This would allow the server when
retired to get more SS.

Yes, actually,  when I was in Miami about 80% of them used
A service charge  / server tip extra billing.

Almost none of them do in CA.

And I doubt the alleged cent an hour will hold up legally.

Very low honestly. The location I work at didn't really ever have new hires, they were very few and far between because before this service model, everyone was very happy and we all made great money

the most accurate way i would describe it as an employee is that the consumer is charged a 20% " service fee" ( not a tip, or gratuity) that goes to " waitstaff" that does NOT include the server or bartender. The 20% is shared between Host, Togo, Bussers, Food Runners, Expo, ETC. The server makes a 8.5% commission rate on all sales, while getting paid 0.01¢ per hour. This is what the photo i posted above is supposed to show. They claim this benefits the servers so they can make more money which is not true AT ALL. Servers originally would work for tips which, if you're good at your job, are around 20% of your sales, which of course is still optional to the consumer. The consumer is now FORCED to pay a service charge of 20% that does not go to the server

only reason why i won't share which location im at exactly is because we've had employees fired for speaking out. but they are all already this way or transitioning into this
