Two points: 1) no, you cannot commit murder in the US and escape to Mexico, but, 2) Mexico won't extradite someone facing the death penalty, so the prosecutor has to drop that option.

The man accused of fatally shooting Harris County Precinct Five Constable Corporal Charles Galloway has been captured in Mexico, according to the U.S. Marshal’s Office. He was found in Ciudad Acuna, which is right across the border from Del Rio, Texas.

Oscar Rosales, 51, who’s been on the run since Sunday, was charged with capital murder.

The arrest was made through a joint effort of Mexican authorities and the Gulf Coast Violent Offenders Task Force. His identity was confirmed through fingerprints, authorities said.

Reina Pereira-Marquez, Rosales’ common-law wife, and Henri Mauricio Pereira-Marquez, her brother, were charged with tampering/fabricating physical evidence.
