The judges ruled the state doesn’t have the authority to require federal law enforcement to wear identification.
SACRAMENTO, California — A federal appeals court on Wednesday blocked enforcement of a California law requiring law enforcement officers to wear identification, saying states lack the authority to impose such rules on federal agents.
The 9th Circuit Court of Appeals granted the federal government’s request for a preliminary injunction, preventing the law from taking effect while the case against it continues to play out in court.
The opinion from the three-judge panel, which includes two Donald Trump appointees, said the law “attempts to directly regulate the United States in its performance of governmental functions. The Supremacy Clause forbids the State from enforcing such legislation.”
Gov. Gavin Newsom last year signed into law a bill from state Sen. Sasha Renée Pérez, a Los Angeles-area Democrat, alongside legislation to ban the use of masks by federal enforcement.
A U.S. district judge in February blocked enforcement of the mask law, saying it discriminates against federal officers because it applied only to federal and local law enforcement but exempted state officers. The judge declined to block the ID law, saying it could be constitutional because it applies to all law enforcement officers working in the state.
The appellate court disregarded that distinction, saying the Supremacy Clause “prohibits States from enacting a law that directly regulates federal operations even if the law regulates state operations in the same manner.”
Pérez in a statement said the ruling was “disappointing, but it is not the final word,” as the fate of the law is still pending.
“Requiring officers to show identification has been a longstanding and widely accepted practice in law enforcement,” she said. “California has both the authority and the responsibility, under its police powers, to maintain order and protect the safety and wellbeing of everyone within its jurisdiction.”
