Limitations on Retroactive Taxation

While broad, the power to enact retroactive taxes does have some limits:

Wholly New Taxes: Challenges may be successful if the legislation creates a "wholly new tax" that taxpayers had no reason to anticipate. However, courts have narrowly interpreted what constitutes a "new tax" versus an amendment to an existing one.

Excessive Period: An "excessive" period of retroactivity may raise due process concerns. The Supreme Court has upheld periods of retroactivity slightly over a year (e.g., 14 months) but suggested that a 12-year period was problematic.
